Overtime Work:

Article (41) stipulates that employees may be required to work overtime based on business needs. Article (3) specifies that the standard weekly working hours are 45 hours. If an agreement sets fewer hours, it will still be considered 45 hours. Any hours exceeding this are considered overtime and are compensated at 50% above the basic hourly wage.

If the official weekly working hours are less than 45, overtime is compensated at 25% above the regular hourly wage until the total hours exceed 45 hours per week, after which overtime is compensated at 50%.

Overtime pay is calculated based on the actual salary.

The maximum overtime is 11 hours per day and 270 hours per year.

Overtime hours must be included in the monthly payroll and are subject to monthly social security contributions.

If the overtime period is less than half an hour, it is rounded up to half an hour. If it exceeds half an hour, it is rounded up to a full hour.

At the end of each year, the employee must sign a document confirming receipt of overtime compensation, specifying its details and dates. This document must be kept in the employee’s file for future reference.

Overtime pay is calculated based on the gross salary, and the Social Security Authority must be notified, with monthly contributions paid accordingly.

If overtime hours are not reported, the authority will impose a fine on the employer. Overtime for the current month must be reported by the following month.

7- Work During Official Holidays and Leaves:

Article (47) of Law No. 4857 stipulates that employees are entitled to a full day’s wage during official holidays as if they performed their duties. If the employee does work on official holidays, the day is compensated as two working days: one regular day and one as compensation for working on a holiday.

Payments are made based on the actual salary.

The Social Security Authority must be notified of additional working days, and contributions are paid accordingly.

8- Work on Weekends:

In accordance with Articles (76) and (63), employees are entitled to at least 24 hours of weekly rest. If an employee works on weekends, the wage is calculated with a 50% increase based on the net salary.
